WELLFLEET CONSERVATION COMMISSION

MINUTES OF MEETING OF OCTOBER 15, 2003, 4:00 P.M., SENIOR CENTER

Present:  Cyndi Moe, Chair; Edwin Reynolds, Chair; Paul Banner,
         Dorothy Dolan, Virginia Page; Emily Beebe, Conservation
         Agent; Erik Mitchell, Assistant; Birgitta Olson, Clerk.

Meeting called to order at 4:10 p.m. under the Massachusetts
Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw by Chair Cyndi Moe.


Business Meeting.

- The Minutes of the meeting of 10/1/03 were approved as amended,
 as MOVED by Page, SECONDED by Reynolds, and CARRIED 5-0.
- Mail was reviewed. The Chair called attention to several
 articles of interest in the MACC Newsletter, including a
 procedure for amending local environmental protection bylaws.
- There was discussion about the area at the sandpit designated
 for aquacultural debris and the need to protect the abutting
 wetland from run-off.
- The Chair reported that Abby Franklin & Harriet Miller had been
 interviewed by Selectmen for the open seat on the Commission.
 Both were present at this meeting.
- A duplicate Certificate of Compliance was signed for Carl Back,
 210 Blue Heron Road, the original having been lost.
- Regulations from other Cape towns concerning allowed uses on
 Town-owned conservation land were reviewed and a draft selection
 made for inclusion in Wellfleet regulations.
- Dottie Dolan confirmed that Friends of the Cape Cod National
 Seashore will not participate in the federal Newcomb Hollow
 beach monitoring and clean-up project this year.


5:00. Public Hearing: Proposed revisions of Regulations in Support of Wellfleet Environmental Protection Bylaw. Chair Cyndi Moe opened the hearing, explaining its purpose and describing the procedure to be followed. Two persons were present. Steve Pechonis questioned paragraph 3 on, page 12 regarding prohibition of any activity in the 50-foot buffer strip. He felt that in cases where physical characteristics of the property made certain things difficult, a window should be left so that people might be able to use land in the buffer strip for something that would not damage the Resource behind it. There were no other comments. Dottie Dolan MOVED "that the Conservation Commission close the hearing."  SECONDED by Paul Banner and CARRIED 5-0. Written public comment on the proposed revisions will be received at the Conservation Office, DPW Facility until 4:00 p.m. 10/22/03. Any such comment will be taken up at the 11/5/03 Commission meeting.

5:30. Town of Wellfleet & Cape Cod National Seashore, NOI: The Gut, off Chequessett Neck Road: Coastal dune, beach & barrier beach protection & enhancement project. Erik Mitchell represented the Town; John Portnoy represented the Seashore. Fencing to trap wind-blown sand will be placed at blow-out areas, with two dune
crossovers located at the north and south ends of the area. No fill is proposed. Attorney Benjamin Zehnder, representing abutter Dan Lynch, said the plans do not clearly show the location of the walkover trails. At the moment one such existing trail appears to be crossing a corner of the Lynch property. Mr. Mitchell said the intent of the NOI is to be generic, that is, not stating that there will be so many feet of fencing placed somewhere, but allowing for placement of fencing as needed in future. Mr. Zehnder said the property owner needs to know how such fencing will impact his property and would like to get a sense of where it is proposed. He suggested signage might be useful in controlling foot traffic. Commissioners suggested that the Lynch property be surveyed and staked. Mr. Mitchell said fencing can be superimposed on the plan for the next session of the hearing. Dottie Dolan MOVED "that the Conservation Commission continue the hearing to 11/5/03 to receive a Natural Heritage Notice and a DEP file number." SECONDED by Ed Reynolds and CARRIED 5-0.

5:50. Town of Wellfleet, Wellfleet Herring Warden & Cape Cod National Seashore, NOI: oFf Route 6, Black Pond Road, Pamet Point Road, Bound Brook Island Road, Duck Harbor Road, Old High Toss Bridge Road, Chequessett Neck Road: Maintenance & improvement of herring run in Herring River. Erik Mitchell represented the Town; John Portnoy represented the Seashore. Herring Warden Jeff Hughes was also present. Mr. Mitchell described proposed restoration work to be undertaken on the river banks to manage stormwater run-off from roads and prevent sedimentation into the river. There will also be selective pruning of trees on the banks, and removal of dead trees in the water, along with leaf detritus clogging the run. Ginie Page asked if something could be done to enable less damaging portaging of canoes and kayaks over certain areas. Abutter Meg Shields asked for reassurance that there will be no cutting of brush and brambles on her property where it directly abuts the river. Mr. Michell said the intent was not to create a park-like area, but only to clear impediments to the fish running. Ed Reynolds MOVED "that the Conservation Commission continue the hearing to 11/5/03 to receive a Natural Heritage Notice and a DEP file number."  SECONDED by Dottie Dolan and CARRIED 5-0.


6:00. Mr.& Mrs. Howard Zinn and Mr.& Mrs. Henry West, RDA: 189 Samoset Road, Map 28, Lot 98: Septic system upgrade. Matt Farrell
presented the plan, noting that all work will be done from the road side of the house. Dottie Dolan MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3."  SECONDED by Ed Reynolds and CARRIED 5-0.

6:15. Paul & Janice Long, NOI, 57 Wigwam Street, Map 34, Lot 158: Additions. David Lajoie, Joy Cuming and Gordon Peabody commented on the plan. Two additions are proposed, one on a full foundation and one on pilings. The number of bedrooms remains the same. It was noted that there is no bank or dune to delineate the Resource area from the upland area. Ginie Page suggested that it be stipulated that the existing garden not be extended further into the Resource, and that in future only indigenous plantings be used.
Paul Banner MOVED "that the Conservation Commission continue the hearing to 11/5/03 to receive a DEP file number."  SECONDED by Ed Reynolds and CARRIED 5-0.
